The U.S. Food and Drug Administration (FDA) regulates cosmetics under the Federal Food, Drug and Cosmetic Act (FD&C Act). Under this law, cosmetics must not be adulterated or misbranded. Packaging and labeling must not be deceptive. Cosmetics marketed on a retail basis must also meet ingredient labeling requirements under the Fair Packaging and Labeling Act.
The FD&C Act defines cosmetics by their intended use, as "articles intended to be rubbed, poured, sprinkled, or sprayed on, introduced into, or otherwise applied to the human body for cleansing, beautifying, promoting attractiveness, or altering the appearance".
The FD&C Act defines drugs by their intended use, as "articles intended for use in the diagnosis, cure, mitigation, treatment, or prevention of disease" and "articles (other than food) intended to affect the structure or any function of the body of man or other animals".

Why is the distinction between cosmetics and drugs important?
The FDA is empowered to examine and investigate products, inspect manufacturing establishments, seize products, secure restraining orders against manufacturers or distributors and initiate criminal actions against individuals violating the law.

Real world examples of violations are claiming cosmetics will cure baldness, grow extraordinary lengths of hair in days, cure split ends, prevent hair loss from chemo and radiation, etc.
